Egypt’s former presidential candidate Abou El Ezz Al Hariri, filed a lawsuit before the Administrative Judiciary Court, at the State Council; calling for rescinding the decision of President Mohamed Morsi that issued on December 1, concerning the referendum on the new constitution.
Al Hariri has called for suspending the president’s decision till adjudicating on the lawsuit No. 116/1934 filed before the Supreme Constitutional Court, which is about immunizing the formation of the Constituent Assembly.
In his lawsuit No. 10920/1967, Al Hariri said the decision released by president Morsi about calling for holding a referendum on the constitution draft is void, because the constitution is also void for many reasons.
Firstly, the decision of forming the Constituent Assembly is unconstitutional, because it includes a number of substitute members that infringe the Article 60 of the constitutional declaration issued in March 2011.
Secondly, the first Constituent Assembly, which was suspended by the Administrative Judiciary Court, is still legal because the Supreme Administrative court hasn’t issued a final verdict so far.
Finally, this Constituent Assembly included 21 members who work in the presidential institution and governors also, so the president has 21 members in the assembly and which violates the Article 60 of the constitutional declaration.
