Florida woman Cynthia Kelly is suing Hershey Company for more than five million dollars after she bought a bag of Reese’s Peanut Butter Pumpkins that shows the chocolates had carved faces on them when the actual chocolate inside was blank.
Hershey accused of misleading reasonable consumers by falsely promising that its candies would contain “explicitly carved out artistic designs.” The case shows Hershey’s breached Florida’s Deceptive and Unfair Trade Practices Act.
Kelly’s suit also points out Reese’s White Pumpkins, Reese’s Pieces Pumpkins, Reese’s Peanut Butter Ghost, Reese’s White Ghost, Reese’s Peanut Butter Bats, and Reese’s Peanut Butter footballs.
