Suit Against Morsi’s Decision Of Canceling Constitutional Declaration

The two lawyers Mohamed Hamed Salem and Khaled Saad Mabrouk filed two lawsuits before the State’s Council against President Mohamed Morsi. The lawsuits called for the necessity of not implementing the president’s decision, which issued on 12 August 2012, of canceling the complementary constitutional declaration that issued in 17 June 2012.

The lawyers said they were surprised, like other Egyptians, by the president’s decision of canceling the complementary constitutional declaration as it is main part of the constitutional declaration issued on 30 Marsh 2011. The lawyers elaborated that Morsi’s power is not based on the constitution but it is based on the constitutional declaration, so his legislation comes from this declaration. Also electing Morsi as Egypt’s president came through the law of the constitutional declaration; the presidential election law.
